Package Holidays

We were instructed by Mr and Mrs C who went on a package holiday in Turkey.
Whilst leaving the hotel complex which they were staying at as part of their package, Mr C slipped on the steps at the front of the property. He unfortunately slipped to the foot of the steps and landed on the pavement below, sustaining back and shoulder injuries. In her attempt to assist her husband, Mrs C was unfortunate enough to slip on the steps and she sustained back injuries.
It transpired that the gardener at the hotel had been watering the plants next to the marble staircase, taking little or no care as to where the water ended up. As a result, the steps became wet and dangerously slippery, causing Mr and Mrs C to fall and become injured.
The claim was pursued under the Package Travel Regulations and we were able to reach an out of Court settlement with the Defendant, despite there being potential problems with the extent of the injuries and complications with degenerative problems. There were also potential complications with contributory negligence, the Defendant having alleged that both Mr and Mrs C were aware of the steps being wet and took no precautions. Despite these problems, the claim settled in the sum of £7,500. |
