£750,000 for holiday maker who ate contaminated burger

burgerThe Daily Telegraph report that a holiday maker who ate a contaminated burger while on holiday in Egypt has won £750,000 in compensation following a two year legal battle with his tour operator First Choice.

Carl Riley was holidaying in the Egyptian resort of Sharm El Sheiikh in November 2004, where he attended a beach barbeque organised by his hotel, the Concorde El Salam. At the barbeque he ate a burger contaminated with the E.coli 0157 bug.

For the remainder of the holiday Mr Riley suffered from diarrhoea and stomach cramps. By the time he returned to the UK he had lost over a stone in weight and continued to feel unwell.

After suffering a nose bleed caused by dangerously high blood pressure in early 2005, he was diagnosed with end-stage kidney failure. The E.coli bug had left Mr Riley with the rare blood disorder Haemolytic Uraemic Syndrome, which required him to need hospital treatment and blood transfusions.

Since contracting the bug and subsequent illness, the affect on Mr Riley’s life has been dramatic. He can no longer work and feels fatigued everyday, is unable to pursue his favourite outdoor hobbies of cycling and fell walking and will continue to need dialysis for the rest of his life - or until he has both a liver and kidney transplant, an operation yet to be successfully performed.

After a two year battle, tour operator First Choice admitted liability and settled out of court, agreeing to pay Mr Riley £750,000 compensation for loss of earnings, future earnings, pension, travelling for dialysis and the maintaining of his home.
